Kevin Benjamin is experienced in real property mortgage law, successfully representing homeowners and commercial clients in Mortgage Foreclosure cases in State and in Federal Court for over 20 years.
eModify, under the supervision of J. Kevin Benjamin, is passionate about assisting homeowners and commercial property owners save their property by negotiating residential loan modifications and commercial loan work-out solutions through pre-litigation negotiations, bankruptcy or filing factual lawsuits against the lender.
- Modification. Benjamin Legal Services will do everything possible to successfully renegotiate client contracts with the lender. Effectively doing everthing legally possible to help keep homeowners in their homes, and commercial property owners retain their properties when faced with an economic hardship, interest rate resets, vacancies, and negative cash flow issues.
- Deed In Lieu. When the home value equals what is owed, a lender may agree to accept a "deed in lieu" instead of pursuing the foreclosure process. Benjamin Legal Services will negotiate a deed in lieu, if determined to be the best corce of action.
- Bankruptcy. If filing for bankruptcy is considered to be in the best interest of our client, based on a careful review of our client's financials, and after exploring and exhausting all options, Benjamin Legal Services will advise and assist our Client's in the filing process.
- Litigation. When absolutly necessary to obtain relief for Clients, Benjamin Legal Services will consider filing a lawsuit against the lender. This course of action could become expensive, time consuming, and there are no gurantees as to the final outcome.
